Consent for sex doesn't extend to filming, sharing private moments: Delhi HC

New Delhi, January 22: The Delhi High Court has ruled that the consent to have sex doesn't allow capturing private moments and posting it on social media.

Justice Swarana Kanta Sharma made this observation while rejecting the bail plea of a rape accused. The court underscored that consent for physical intimacy cannot be stretched to include permission for exploiting or misusing private images.

"Even if the complainant had granted consent for sexual relations at any point, this cannot be interpreted as consent to record or post inappropriate videos on social media platforms. Consent to engage in physical intimacy does not encompass the misuse or exploitation of private moments or their portrayal in an inappropriate or degrading manner," Justice Sharma stated in a verdict delivered on January 17.
