Cuttack, January 22: The Orissa High Court dismissed a petition filed by an MBBS aspirant who had secured a good state rank in the NEET UG Exam.
With moving the High Court the aspirant sought compensation after being denied an MBBS seat at a government medical college due to an alleged technical glitch during final counseling round.
Hearing the pleas of one Aryan Swarup Parida, a division bench, comprising the Chief Justice and Justice Savitri Ratho, cited it a “disputed question of fact” and disposed it off.
As the case record read, the petitioner, had secured an All-India Rank of 16,663, a category rank of 7,185, and a state rank of 599 in the NEET UG Exam. However, he lost admission due to technical glitch on the Medical Counselling Committee's (MCC) web portal that prevented him from participating in the All-India Quota (AIQ) Mop-up and Stray Vacancy Rounds. Consequently, he missed the opportunity to lock his choices for government medical institutes.
The Medical Counselling Committee, however, denied any glitch on its official Website on the said day.
Based on the opposite party’s deposition, The Orissa High Court observed that this presented a contradictory claim of facts.
Further, the court also noted that the AIQ counseling that comprises four statutory rounds i.e AIQ Round 1, AIQ Round 2, AIQ Mop-up Round, and AIQ Stray Vacancy Round wherein Parida was knocked out in the first two rounds.
The division bench, however, dismissed the plea, ultimately finding no merit in the pleas.
