Bhubaneswar: It seems The End to the longstanding marital discord between cricketer Yuzvendra Chahal and his estranged wife actor Dhanashree Verma on March 20.
The spin to the story here is Wednesday Bombay High Court has allowed a plea filed by Chahal and his estranged wife Dhanashree Verma that sought a waive off the cooling-off period of six months stipulated under Section 13B of the Hindu Marriage Act for a divorce decree.
Single-judge Justice Madhav Jamdar has also directed the family court to decide the divorce petition by tomorrow considering the cricketer’s participation in the upcoming Indian Premier League (IPL).
"As petitioner 1 (Chahal) is participant of IPL, learned counsel informs that he may not be available from 21st March, the learned judge family court is requested to decide petition by tomorrow," the Court directed.
Wristy spinner Chahal plays for the Kings XI Punjab IPL team, and is set to join his team for the league commencing on March 22.
Justice Madhav Jamdar passed the order after considering the fact of both Chahal and Verma living apart for over two and a half years and that there was compliance with the consent terms arrived at during mediation between the two parties as regards payment of alimony.
RELIEF FOR CHAHAL
It needs mentioning that a family court on February 20 has declined the request of waiving the statutory cooling-off period.
The family court declined on on the ground that there was only partial compliance with the consent terms that mandated Chahal to pay Rs4.75 crore to Dhanashree, but he had paid Rs2.37 crores.
Taking this fact into consideration, the family court also mentioned a report of the marriage counselor that reported of only partial compliance with the mediation efforts.
Following the rejection by Family court, Cricketer and his actor wife moved to the Bombay HC.
WHY HC ALLOWED THE PLEA?
The single judge of Bombay HC Justice Madhav Jamdat observed that there was compliance with the consent terms as it provided for the payment of the second installment of permanent alimony only after the decree of divorce.
The order observed:
"Thus it is clear that there is no impediment in the facts and circumstances of the case in granting the applications... Accordingly, impugned order dated 20th February is quashed and set aside and the writ is allowed."
WHAT IS COOL-OFF PERIOD?
As per Section 13B(2), a family court can consider a mutual petition for divorce only after six months from the date of its filing. The cooling-off period is provided to explore possibilities of settlement and reunion.
However, the Supreme Court in 2017 case of Amardeep Singh vs Harveen Kaurruled that the six-month cooling-off period for mutual consent of divorce under section 13B (2) of the Hindu Marriage Act is not mandatory, but directory.
It had also held that the said period can be waived off in case there is no scope for settlement of dispute between the parties.
In the instant case, Cricketer Chahal and actor Verma got married in December 2020 and has been separated in June 2022.
They filed a joint petition before family court on February 5 seeking divorce on the basis of mutual consent, also seeking a waiver of the cooling-off period.
DHANSHREE’S TENSE - FIERY POST
Meanwhile, after the Bombay HC order, actor Dhanshree Verma has posted a post on her Instagram, where the actor was seen in a disturbed mood with flames behind. The actor has posted two emozis - love and fire.
As per love psychology, Dhanshree wishes to deliver a message to her supporters/fans that she was feeling disturbed as her love went into flames. Moreover, as she posted a heart and fire emoji, it seems she is making some statement about her passionate love.
