Delhi High Court dismisses petition to declare Shri Ram Janmbhoomi Trust a public authority

New Delhi, Dec 20: The Delhi High Court declined to entertain a petition on Friday that sought to classify the Shri Ram Janmbhoomi Teerth Kshetra Trust as a public authority. 

The petition was filed by Neeraj Kumar, challenging the Central Information Commission’s (CIC) decision from July 8, 2022, which had denied disclosure of information about the Chief Public Information Officer (CPIO) and the First Appellate Authority of the Trust.

Kumar had previously filed a Right to Information (RTI) request with the Ministry of Home Affairs (MHA) in July 2022, asking for the same information, but his request was rejected. The MHA argued that the Shri Ram Janmbhoomi Teerth Kshetra Trust is not owned, controlled, or financed by the Government of India, and thus does not qualify as a public authority.

Represented by lawyer Prashant Bhushan, the petitioner sought the Delhi High Court’s intervention to overturn the CIC’s decision. The case was heard by a bench of Justice Sanjeev Narula. Both the Ministry of Home Affairs (MHA) and the Shri Ram Janmbhoomi Teerth Kshetra Trust opposed the petition. Senior advocates Chetan Sharma (ASG) and Nishant Gautam (CGSC) argued that the Trust is an autonomous body and should not be treated as a public authority.

After hearing arguments from both sides, the court chose not to intervene and instead disposed of the petition, directing the parties to present their case before the CIC.
