New Delhi, November 18: The Supreme Court on Monday declined to entertain a petition requesting an inquiry into the death of Netaji Subhash Chandra Bose.
A bench comprising Justices Surya Kant and Ujjal Bhuyan stated that such matters fall outside the judiciary's purview and emphasized that courts are not responsible for governance.
The petitioner, Pinak Pani Mohanty, had argued that Bose's death remains a mystery with no conclusive evidence regarding his disappearance. However, the bench remarked that the judiciary is not equipped to resolve such issues, advising the petitioner to approach appropriate forums instead of seeking judicial intervention.
"Supreme Court har cheez ki dawa nahi hai. Sarkar ko chalana court ka kaam nahi hai (The Supreme Court is not a remedy for everything. Running the government is not the court's job)," Justice Kant observed, stressing that the judiciary's role is to address legal questions rather than policy matters.
The court further criticized the petitioner for making unsubstantiated allegations against deceased national leaders, cautioning that such claims require careful scrutiny. The bench directed Mohanty to submit an affidavit detailing his contributions to societal welfare and human rights advocacy.
